§ 1 General terms and regulations
- Online store operating at the address https://lifetec.design (hereinafter referred to as the “Store”) is operated by LIFE-TEC Maciej Dębowski, registered in Warsaw (01-494) at ul. Mieczysława Wolfkego 1/7., NIP 5222808797.
- These terms and conditions (hereinafter referred to as the “Terms and Conditions”) set out the rules and conditions for using the Store, including the rules for concluding sales agreements for products offered by the Store.
- The terms used in these Terms and Conditions shall have the following meanings:
- Seller – the entity referred to in section 1 of this paragraph.
- Client – a natural person with full legal capacity, a legal person, or an organizational unit without legal personality, to which the law grants legal capacity, making purchases in the Store.
- Consumer – A customer who is a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
- Product – movable property (finished product or custom-made product) or digital content (digital product) available in the Store, which is the subject of the Sales Agreement.
- Custom-made product – a non-prefabricated product, manufactured according to the customer's specifications or serving to satisfy their individual needs.
- Finished product – prefabricated product, available in the Store's permanent offer.
- Digital product – digital content that the Customer receives under the Sales Agreement, not delivered on a physical medium (e.g., e-books, image files, software).
- Sales Agreement – a contract for the sale of a Product concluded or entered into between the Customer and the Seller via the Online Store.
- Business day – one day from Monday to Friday, excluding public holidays.
§ 2 Services provided electronically
- The Seller provides the following services electronically via the Store:
- Enabling the placement of orders and the conclusion of Sales Agreements on the terms specified in these Terms and Conditions.
- Maintaining a User account in the Store
- To use the Store, including browsing the product range and placing orders, you need a device with Internet access and a web browser such as Chrome, Firefox, Safari, Edge, or similar, as well as an active email account.
§ 3 Rules for placing orders
- Customers can place orders for Products available in the Store's assortment 7 days a week, 24 hours a day.
- To place an order, you need to:
- Select the Product or Products you wish to order, then add them to your shopping cart.
- Provide the information necessary to complete the order (first and last name, delivery address, email address, phone number).
- Select one of the available delivery and payment methods.
- Accept the Terms and Conditions and place your order by clicking on the “Order and pay” button or its equivalent.
- Placing an order constitutes the Customer's offer to the Seller to conclude a Sales Agreement for the Products covered by the order.
- After placing an order, the Seller shall immediately confirm its receipt by sending an appropriate message to the Customer's e-mail address. Upon receipt of the above e-mail message by the Customer, the Sales Agreement shall be concluded.
§ 4 Payments
- The prices of all Products in the Store are gross prices (including VAT) and are expressed in Polish zlotys (PLN) or another currency, if such an option is available.
- The customer can choose the following payment methods:
- traditional bank transfer,
- płatność BLIK
- online payment via przelewy24.pl,
- payment card,
- The Customer is obliged to make payment within 3 days of the date of conclusion of the Sales Agreement. After the ineffective expiry of this period, the Seller may withdraw from the agreement.
§ 5 Order fulfillment and delivery
- The order completion date depends on the type of Product:
- Finished products: The order is processed and prepared for shipment within 5 business days from the date of payment being credited to the Seller's account.
- Custom-made product: The delivery time, including preparation and delivery, will be specified individually in each case in the agreement or arrangements with the Customer, which form an integral part of the Sales Agreement.
- Products can be delivered both within the territory of the Republic of Poland and as international shipments to European Union countries.
- The customer can choose the following delivery methods:
- Courier/mail delivery (domestic and foreign).
- Personal collection in Warsaw, after prior agreement of the address and date with the Seller.
- Delivery costs are indicated during the ordering process and depend on the selected delivery method, the weight and dimensions of the order, as well as the customer's location.
§ 6 Right to withdraw from the Sales agreement
- A consumer who has concluded a distance contract may withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs specified in paragraphs 8 and 9 below.
- The withdrawal period begins when the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the Product.
- The consumer may withdraw from the contract by submitting a statement of withdrawal from the contract to the Seller. The statement may be submitted on the form. [form template].
- To meet the deadline, it is sufficient to send a statement before its expiry to the address of the Seller's registered office or e-mail adress – biuro@life-tec.pl.
- In the event of withdrawal from the contract, the contract shall be deemed not to have been concluded. The Seller shall immediately refund the Consumer all payments made by him, including the costs of delivery. The Seller shall refund the payment using the same method of payment as used by the Consumer, unless the Consumer has expressly agreed to a different method of refund. The refund shall be made no later than within 10 days from the date of receipt of the Consumer's statement of withdrawal from the contract in the event of non-delivery of the Products or within 5 days from the date of receipt of the returned Products.
- The consumer is obliged to return the Product to the Seller immediately, but no later than 14 days from the date on which they withdrew from the contract. To meet the deadline, it is sufficient to send the Product back before its expiry.
- The consumer bears the direct costs of returning the Product.
- If the Consumer has chosen a method of delivery other than the cheapest standard method offered by the Seller, the Seller is not obliged to reimburse the Consumer for the additional costs incurred.
- The consumer is liable for any damage or reduction in the value of the goods resulting from their use in a manner exceeding that necessary to establish their nature, characteristics, and functioning.
- Returns should be sent to the following address, accompanied by written notification of the return and the order number for customer identification purposes: LIFE-TEC Maciej Dębowski, Wolfkego 1/7, 01-494 Warsaw.
§ 7 Loss of right to withdraw from the Sales agreement
- In accordance with Article 38 of the Act of May 30, 2014 on consumer rights, the right to withdraw from a distance contract is not eligible to the consumer with regard to contracts:
- For the service, if the business has fully performed the service with the express consent of the consumer,who was informed before the start of the service that they would lose their right to withdraw from the contract once the entrepreneur had performed the service.
- Where the subject of the service is a custom-made Producti.e., a non-prefabricated product manufactured according to the consumer's specifications or serving to satisfy their individual needs (Article 38(1)(3) of the Act).
- For the delivery of a Digital Product that is not recorded on a tangible medium,if the fulfilment of the service began with the Consumer's express consent before the expiry of the withdrawal period and after the Seller informed the Consumer about the loss of the right to withdraw from the contract (Article 38(1)(13) of the Act). By accepting these Terms and Conditions and consenting to the delivery of digital content before the expiry of the withdrawal period, the Customer acknowledges that they thereby lose their right to withdraw from the contract.
§ 8 Complaints
- The Seller is obliged to deliver a Product free from defects to the Customer (warranty).
- In the event of a defect in goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions of the Civil Code regarding warranty.
- Complaints should be submitted in writing or electronically to the Seller's email address provided in these Terms and Conditions.
- The complaint should include, among other things, a concise description of the defect, the circumstances (including the date) of its occurrence, the details of the customer submitting the complaint, and the customer's request in relation to the defect in the goods.
- The seller shall respond to the complaint immediately, no later than within 14 days.
§ 9 Protection of personal data (GDPR)
- The Seller is the administrator of Customers' personal data collected via the Online Store.
- Detailed information on the processing of personal data, including the Customer's rights, can be found in the Privacy Policy available on the Store's website.
§ 10 Final regulations
- In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular: the Civil Code; the Act on the provision of electronic services; the Act on consumer rights.
- The Seller reserves the right to amend the Terms and Conditions for important reasons, i.e.: changes in legal regulations; changes in payment and delivery methods – to the extent that these changes affect the implementation of the provisions of these Terms and Conditions. The Seller shall notify the Customer of any changes at least 7 days in advance.
- The current Terms and Conditions are always available to the Customer in the Terms and Conditions tab on the Store's website.
